PRICES AND TERMS

A $50.00 minimum order is required. Net 30, FOB Cleveland, OH., unless otherwise specified. Prices are in U.S. dollars and are subject to change. Visit www.resorg.com for current prices. At placement of order by phone, we will confirm our price Advance payment is required until open credit is established. We reserve the right to request advance payment in certain cases. The buyer is responsible for associated bank charges for all overseas transactions. Research Organics accepts Visa, Mastercard, and American Express.

QUALITY

Our biochemicals are analytically tested before released for shipment. Certificates of Analysis are issued for every chemical, and Trace Metal Analysis accompany applicable products. Purity values listed in this catalog are typical and actual values may vary from lot to lot. Specifications may change; reasonable variation from listed value may not be basis for dispute.

RETURNS

Please contact Customer Service to report a problem with a product, order or delivery or to request a return on a product. Research Organics requests that the buyer inspect all packages immediately upon receipt of order and notify Customer Service of any problems or damages. Before returning any product, contact Customer Service for a return authorization. No returns permitted without prior written authorization. Returns must be made within 30 days of receipt of authorization form. Copy of authorization must accompany returned shipment. Failure to return material within this time can render the complaint null and void. If products are mutually agreed to be nonconforming or defective, Research Organics will replace the product without charge, refund the purchase price or issue a credit to your account. Replacement of product, refund or credit is solely at the discretion of Research Organics. If a product is returned without proper issuance of authorization, Research Organics may not accept the return and full replacement or credit may not ensue. Returns accepted for products incorrectly ordered may be subject to restocking charge.

CONDITIONS FOR USE

Research Organics’ listed products are intended for laboratory research use only and not to be used for any other purpose, including but not limited to; drug, food, food additive, cosmetics or clinical use in humans, unless otherwise stated on our product labels or in literature supplied to the buyer. We may reject orders from private individuals not affiliated with an organization. We reserve the right to insist on a written order and/or references before proceeding on an order. The buyer may be asked to provide written assurance that chemicals not be purchased/resold for an improper use.

SHIPPING AND PACKAGING

Rush orders for items in stock will be shipped within 24 hours. Best method of shipment will be used based on package size, weight, content and destination in accordance with D.O.T. regulations. Special or hazardous shipments may incur additional charges for packaging. Please inspect goods upon receipt and notify us of defects or shortage within five days, and quality complaints within 30 days. To assist us in expediting international orders, a contact name, fax number and telephone number should be included on your purchase order. Indicating your broker or shipping agent’s name, fax number and telephone number will also help clear your shipment through customs.

ENVIRONMENTAL & SAFETY REGULATORY NOTIFICATION

Only qualified technical personnel acquainted with safe laboratory practice and potential chemical hazards should handle chemicals. The buyer is responsible for the handling, safe use and disposal of Research Organics’ products.

The buyer shall not adulterate or misbrand Research Organics’ products in violation of federal laws.

Since all listed products are primarily for research, the product purchased may not be listed in U.S. EPA inventory under section 8(b) of the 1976 Toxic Substances Control Act (TSCA) or other TSCA requirement; EINECS; ELINCS; NONS; or any other international chemical inventory list. Research Organics’ plant growth regulators or media containing plant growth regulators are intended for laboratory use, plant tissue culture media preparation and plant research purposes only. Plant growth regulators or media containing plant growth regulators have strict notifications and labeling requirements under the 1998 Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) regulations. The buyer assumes responsibility to ensure approval for use under TSCA and/or FIFRA of any product purchased from Research Organics. Several chemicals may have special regulations that the buyer must meet in order to use or export/import the product.

We provide Material Safety Data Sheets (MSDS) and information on our product labels regarding potential or known hazards from various regulatory agencies and chemical databases. However, many compounds do not have available hazardous information. The absence of hazardous warning(s) does not indicate safety, and due care must still be taken in its use.

WARRANTY/DISCLAIMER

Research Organics warrants that our products are of merchantable quality at time of sale and conform to descriptions in our catalog and other product literature. There is no warranty, express or implied, as to the fitness of these products for any particular purpose. Research Organics’ sole obligation is to replace the product without charge or to refund the purchase price. In no event shall Research Organics be liable for incidental or consequential damages that may result from any use or failure of the product.
